A few years ago, a client of mine contracted out its alfalfa hay harvesting and baling. They were using cubers last manufactured by John Deere in 1974, and had resorted to stockpiling machines from all over the country (parts cars on a big scale) to keep the cubers running. In the end, they were custom fabricating parts.
Since 2006, they have been converting their land to almonds. In 2012, they closed their dairy and they grow the hay for their beef feedlot and to sell to dairy farmers. This has led them reducing their workforce.
My client laid off 6 workers when they contracted out the hay harvest to a company with modern equipment who could do it in a fraction of the time at a dramatically lower cost.
5 of 6 signed severance agreements with waivers of claims and agreements not to sue, in exchange for time to move out of the houses and for a little money going out the door.
To make a long story short, they found lawyers who want to invalidate the agreements and claim wrongful termination. Today they started at $1.2 million and came down to $600,000. I see some stupid shit, but this one is crazy.

What sort of leg are they standing on? I’m guessing the argument goes that providing housing was an implicit contract?

At I’ve learned, it just doesn’t pay to employ people. I’m reducing staff from 3 full and 3 part-time to 1 full and 1 part-time. As a result my life is significantly less stressful even though I have to do a lot more work.
